Military Leave of Absence


County of Orange employees who are members of the Armed Forces are entitled to 30 days of paid military leave each fiscal year per the California Military and Veteran's Code (Section 395.01). In order to receive the 30 days of paid military leave the employee must provide a copy of their military orders, and any subsequent extensions, to the Professional Standards Division, attention Christina Rivas as soon as possible.

 If an employee is deployed past the 30 days on an extended military leave, the employee may be eligible for supplemental military pay per Board Resolution 01-350 adopted on October 16, 2001. The supplemental military pay benefit was put into effect as a result of the National Emergency with respect to terrorism as declared by the President's Executive Order 13224 on September 23, 2001, and the resolution has been extended until such time that it is discontinued by the Board.

 

To be eligible for the supplemental military pay, the employee must submit a current leave and earnings statement from their branch of service in addition to their Active Duty military orders. The leave and earnings statement (LES) must provide the employee's pay grade and years of service. A new leave and earnings statement must be provided every calendar year. This information enables the County to determine the correct amount of supplemental pay that is to be paid to the employee.

 

Failure to provide the LES statement/military pay stub prior to the employee's deployment date will result in cancellation of the employees County paycheck after 4 pay periods. The overpayment earnings received during this four week period and any overpayments going forward will be required to be repaid upon the employees return to work with the Sheriffs Department.
